    Online Store Terms of Sale

    These Terms of Sale ("Terms") govern your purchase of in-stock and individual retail items from Marauder Merchandise ("Marauder Merchandise," "we," "us," or "our") through maraudermerchandise.com. By placing an order, you agree to these Terms. Custom, contract, or bulk decoration orders are governed by our Custom Printing & Decoration Terms instead.

    1. Orders and Order Acceptance

    All orders are offers to purchase and are subject to our acceptance. We may decline or cancel an order for any reason, including product or artwork unavailability, errors in pricing or product information, or suspected fraud. An order confirmation acknowledges that we received your order; a binding contract forms only when we accept the order and begin processing it.

    2. Pricing and Payment

    Prices are listed in U.S. dollars and are subject to change. Payment is due in full at the time of purchase. Applicable sales tax is calculated and added at checkout as required by law. By submitting an order, you authorize us to charge your selected payment method for the full order total, including shipping and tax.

    3. Product Appearance and Variations

    Garment colors, print colors, and product styles may vary slightly from what appears on your screen due to monitor settings, dye lots, and manufacturing differences. Stock items are subject to availability; if an item or size becomes unavailable, we will contact you to arrange a comparable substitute or a refund for the affected items.

    4. Intellectual Property

    All content on the Site — including our name, logos, designs, product images, and text — is owned by Marauder Merchandise or our licensors and is protected by law. You may not copy, reproduce, or use it without our written permission. If you submit any content to us, you represent that you own or have the right to use it, and you agree to indemnify and hold us harmless from any claim arising out of content you supply.

    5. Shipping and Delivery

    We aim to ship orders that are not flagged as preorders within 48 hours after the order has been processed. This is a target, not a guaranteed timeframe. Delivery transit times depend on the destination, carrier, and shipping method, and are estimates only. If we cannot ship within the time stated or, if no time is stated, within 30 days of receiving your order, we will notify you, and you may agree to the delay or cancel the affected items for a full refund.     6. Preorders

    Items offered as preorders are not yet in stock and ship on or after the estimated availability date shown for the item. Preorder timelines are estimates and may change. If an order contains both preorder and in-stock items, we may ship them together or separately at our discretion.

    7. Returns and Refunds

    Many of our products are made to order and are final sale. We accept returns or provide refunds only for items that arrive damaged, defective, or different from what you ordered due to our error.     8. Disclaimer of Warranties

    EXCEPT FOR THE REMEDY FOR DAMAGED, DEFECTIVE, OR INCORRECT ITEMS DESCRIBED IN OUR RETURNS & REFUNDS POLICY, OUR PRODUCTS AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

    9. Limitation of Liability

    To the fullest extent permitted by law, the total liability of Marauder Merchandise arising out of or relating to any order is limited to the amount you paid for the affected products. We are not liable for indirect, incidental, or consequential damages — including lost profits or business interruption — arising out of your purchase or use of our products.

    10. Privacy

    Your use of the Site and your purchases are also governed by our Privacy Policy.

    11. Governing Law

    These Terms, and any dispute arising out of or relating to your order, are governed by the laws of the State of Kansas and applicable United States federal law, without regard to conflict-of-law principles. Venue for any dispute lies in the state or federal courts located in the State of Kansas.

    12. Changes to These Terms

    We may update these Terms from time to time. The version in effect when you place your order applies to that order.

    13. Miscellaneous

    These Terms, together with the policies referenced here, are the entire agreement between you and us regarding your retail purchases. If any provision is found unenforceable, the remaining provisions stay in effect. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. Our failure to enforce any provision is not a waiver. We are not liable for delays or failures caused by events beyond our reasonable control.
